Terms for practices.
These apply to a practice using Maybe Therapist and to everyone it adds as staff, on top of the terms every Maybe account agrees to.
Current as of 30 September 2026, during early access. A lawyer will tighten the wording; what you are promised will not get weaker, and changes that matter are emailed to the practice before they apply.
Early access, by invitation.
Maybe Therapist is open by invitation while we bring practices on a few at a time, starting in Australia. It will change as we learn from the practices using it, and we will tell you before anything you rely on changes or goes.
What it is, and what it is not.
A way to set your patients practice between sessions and to see what they choose to share with you. It is not a medical device, not a clinical record system of record, and not a monitoring or alert service. Your notes of record stay in your own software; the dated record you can export is made to be filed there.
Your patients’ coach is an AI model. It can be wrong, and its safety rules sit above anything you set it to work on. Nothing it says is your advice, and nothing it says replaces your judgement.
Your clinical responsibility stays yours.
Deciding whether Maybe suits a patient, what to set them and what to make of what they send back is your clinical judgement, and your duty of care to your patients is unchanged by using it. It does not diagnose, treat or assess anyone.
Your patients’ consent, and their information.
Before you link a patient, tell them what you will see and how you will use it, and get their consent in the way your professional and privacy obligations require. They choose what to share at linking and can change it or unlink at any time, and you respect that choice.
What a patient shares is encrypted on their device under a key your care team holds, and we cannot read it. Once you have opened it, it is information your practice holds, and your practice is responsible for it under its own privacy obligations, which in Australia are the Australian Privacy Principles. Keep your own privacy policy and give it to your patients. What we can see about the practice and its links is set out in the privacy policy.
It does not watch your patients for you.
Nothing in Maybe Therapist reaches you as it happens. You see what a patient shared when you next open the portal. A patient can choose to let you know that they opened Get help now; you learn it when you next look, and it is not an alert. Do not rely on Maybe to know that a patient is at risk, and keep your usual crisis and after-hours arrangements in place.
Australia first, and no real US patients yet.
Early access is for practices in Australia. A practice elsewhere may try Maybe Therapist with its demo patient, which is made up. A practice in the United States must not link a real patient, or enter anything about one, until we have the arrangements HIPAA expects in place with it, including a business associate agreement. We will say when that changes.
Your staff, and your keys.
You decide who joins your practice and in what role, and you remove anyone who leaves. Clinicians see the patients on their care teams; the records lead can open every care team in the practice; a practice manager sees who is linked and who pays, never what patients share.
Each person keeps their own passphrase and recovery code to themselves. They open what patients share, and we cannot recover them: lose every way in and what was sealed to you cannot be opened again, by you or by us.
Paying for it.
Once your practice sets up billing, it pays monthly for each clinician, and for each patient seat it chooses to give, which covers that patient’s subscription. A practice manager who does not see patients is not charged. The price is agreed with you before anything is billed, includes GST for Australian practices, and runs through Stripe, so card details never reach us. Seats and clinicians can be added or removed as you go.
Ending it.
A practice can stop whenever it likes. Its patients keep their own Maybe accounts; their links to the practice end, and so does any seat it paid for. We can suspend or close a practice that misuses the service, puts its patients or its security at risk, or does not pay, and we will tell you why. If early access ends, you get 30 days’ notice by email.
Where responsibility sits.
Maybe Therapist is provided as it stands, without a promise that it is always up or always right. Nothing here excludes the guarantees the Australian Consumer Law gives a business, which cannot be signed away. Beyond what the law requires, our liability to a practice is capped at what it paid us in the six months before the claim. These terms run under Australian law.
